1. Subject of the agreement
1.1. This agreement regulates the relationship between PH HOME LLP (Contractor) and the client (Customer) in the framework of the provision of the following services:
Development of draft house designs.
Production of physical 3D models of houses.
2. Definitions and terms
2.1. "Sketch project" is a set of drawings and visualizations of a house.
2.2. "Ready—made project" is an already developed house project without taking into account the individual characteristics of the client's site and additional wishes.
2.3. "3D model" is a physical model of a house made to order based on a draft design.
3. Terms of service provision
3.1. All stages of the work are agreed with the client in writing (e-mail, messenger, questionnaires on the website).
3.2. The transfer of draft designs is carried out electronically.
3.3. The production of the 3D model begins only after receiving the written consent of the client.
3.4. The terms of the services are negotiated individually and depend on the complexity of the project.
4. Rights and obligations of the parties
4.1. Rights of the contractor:
Request an advance payment for services.
Suspend work in case of late payment.
4.2. Obligations of the contractor:
Perform the work efficiently and within the agreed time frame.
Provide advice to the client at the design stage.
4.3. The rights of the customer:
Make adjustments before agreeing on the production stage.
To refuse services until they are performed in accordance with the terms of this agreement.
4.4. Obligations of the customer:
Provide accurate data and materials for the work in a timely manner.
To pay for services on time.
5. Price and payment procedure
5.1. The cost of ready-made projects is indicated in the "Ready-made products Store" section on the Contractor's website. The customer pays its full cost (100%) and receives the draft design immediately. Also, after confirmation from the Customer, the Contractor begins the process of making a 3D model.
5.2. The cost of finished projects increases if the customer wishes to make adjustments to the project, and there is also a need to link the house to the site.
5.3. For custom-made projects, the final cost is calculated based on the selected parameters (area, additional buildings, etc.) and the binding of the house to the site.
5.4. For ready-made projects requiring adjustments and for custom projects, the prepayment is 30% of the total cost. The remaining 70% is made after agreeing on the preliminary design before starting the production of the 3D model.
5.5. If the project parameters are changed at a meeting with the client, the cost is recalculated.
6. Responsibility of the parties
6.1. The Contractor is not responsible for the discrepancy between the client's expectations and the results of the work, if they correspond to the agreed project.
6.2. The Customer is responsible for the accuracy of the data provided by him.
6.3. All changes (based on the wishes of the customer and the Contractor's proposals) are agreed upon by the parties prior to the development of the project. After the project is developed, the Customer has the right to request changes to the project once more.
7. Force majeure
7.1. The Parties are released from liability for non-fulfillment of obligations under this agreement in case of force majeure (natural disasters, man-made accidents, military operations, etc.).
8. Term of the agreement
8.1. The Agreement comes into force from the moment the client pays for the services and is valid until the parties fully fulfill their obligations.
9. The procedure for making a refund
9.1. The Client has the right to request a refund if it is provided for in the refund policy.
9.2. In order to make a refund, the customer must provide a written statement, including:
full name and contact information;
The reason for the refund;
The date of application submission;
Bank details for the transfer of funds.
9.3. Refunds are made within 10 business days from the date of receipt of the application and verification of compliance with the refund conditions.
10. Dispute settlement
10.1. All disputes arising from this Agreement shall be resolved through negotiations.
10.2. If the dispute cannot be settled amicably, it is referred to the court at the Contractor's location.
11. Privacy
11.1. The Contractor undertakes to use the Customer's personal data only for the performance of this agreement and not to transfer them to third parties.
12. Final provisions
12.1. The placement of this offer agreement on the Contractor's website is considered a public offer in accordance with the legislation of the Republic of Kazakhstan.
12.2. By placing an order, the customer confirms their agreement with the terms of this agreement.
12.3. The Contractor reserves the right to make changes to the agreement by notifying clients about it through the website.
